Privacy policy

At Malaga Creators we handle your personal data transparently and only for what we need. This policy explains what data we collect through the contact form, why, and what your rights are, under Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).

1. Data controller

2. Data we process

The data you provide in the contact form: name, company or brand, email, phone (optional), type of request, event date and location, number of creators, niches of interest, approximate budget and your message. We also automatically receive the page language, the URL from which you submit the form and, if present, the campaign (UTM) parameters in that URL, so we know which channel you found us through.

Please do not include special category data (health, beliefs, etc.) in your message.

3. Purpose

To respond to your business enquiry: send you information, a creator proposal and a quote, and keep in touch about it. We do not profile you or make automated decisions. We will not send you unsolicited marketing communications.

4. Legal basis

Taking steps at your request prior to entering into a contract (Art. 6(1)(b) GDPR) and your consent when submitting the form (Art. 6(1)(a) GDPR), which you may withdraw at any time.

5. Retention

We keep your data while handling your request and, if no business relationship results, for a maximum of 12 months. TODO: confirm period If a relationship is formed, for its duration and the applicable statutory limitation periods.

6. Recipients and processors

We do not share your data with third parties unless legally required. To provide the service we work with the following providers acting as data processors:

  • Web3Forms — contact form delivery service that receives the form data and forwards it to our email. Purpose: delivering your business enquiry to us. More information at web3forms.com/privacy.   • Cloudflare, Inc. — website hosting (Cloudflare Pages), content delivery network and aggregated, cookieless visitor analytics (Cloudflare Web Analytics). Cloudflare participates in the EU-U.S. Data Privacy Framework. TODO: verify
  • Google (Gmail) — email service where we receive and reply to messages. Google participates in the EU-U.S. Data Privacy Framework. TODO: verify
  • hCaptcha (Intuition Machines, Inc.) — only if the form's anti-spam check is enabled. TODO: remove this line if hCaptcha is not enabled

If we share your request with content creators to prepare a proposal, we will do so without your personal contact details unless you expressly authorise it.

7. Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction and portability, and withdraw your consent, by emailing malagacreators@gmail.com stating the right you wish to exercise. If you believe we have not handled your request properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

8. Security

The site is served exclusively over an encrypted connection (HTTPS) and we apply reasonable technical and organisational measures to protect your data.

9. Changes to this policy

We may update this policy to reflect legal or service changes. We will always show the date of the last update.
